Module 1: “Effectively Connecting and Meeting with Employers to Pursue Direct Services” | Presented by: Jeff Hathaway, PT, DPT; Josh A. Bailey, PT, DPT
NewModule 1 has been revamped into two parts: a pre-recorded presentation (accessible in the Learning Center) and an interactive role-playing workshop. Active participation in both components is encouraged for an enriched learning experience. Interactive role-playing workshop via Zoom on four separate occasions in 2024 (choose ONE session to attend).

The live, 3-hour interactive role-playing workshop will train the participant in getting initial meetings with employers and holding effective meetings to move from the initial discussion, through understanding their problem, to getting to a "yesable” solution that effectively addresses the employer's interests and brings them what they need (commonly called ‘interest-based negotiation’).
IMPORTANT: Module 1 workshop requires interactive participation; because of this, space is limited to attend this session. You will be asked to select your module 1 presentation date when completing your registration. Module 1 workshop will not be recorded; YOU MUST BE ABLE TO ATTEND THE ENTIRE LIVE SESSION!
Module 2: “Understanding the Business of Direct-to-Employer Contracting” | Presented by: Holly Johnson, PT, DPT; Kelly Sanders, PT, DPT, ATC; Rick Katz, PT, DPT, MA

This module is a virtual instructional session on the business of providing and contracting direct-to-employer services. Topic areas will include proposal creation, product planning, implementation, and product support and management. This module prepares the participant to enter into simple service contracts that involve low-risk contracting, such as payment at an hourly rate or project rate. Contracting can have many features too numerous for a module like this, and it takes time and experience to develop the knowledge and skills for more complex and higher-risk contracts.
Module 3: “Legal Considerations for Direct-to-Employer Services” | Presented by: Paul Welk, PT, JD; Albert Lee, JD
This course was recorded in January 2023
This course will explore some of the legal and regulatory issues that arise with direct-to-employer contracting for physical therapy and other services. It will touch upon issues related to workers' compensation, the Equal Employment Opportunity Commission (EEOC), the Health Insurance Portability and Accountability Act (HIPAA), the Americans with Disabilities Act (ADA), the Employee Retirement Income Security Act (ERISA), the Occupational Safety and Health Administration (OSHA) and other key legal topics to provide participants with a basic understanding of how these issues relate to the provision of services. This course will also cover some of the key contract provisions to consider when contracting directly with employers.

Holly Johnson PT, DPT Cert.MDT is a graduate of the University of Kentucky Physical Therapy Program and received her transitional doctoral degree from AT Still University in 2005. She has recently retired from a 32-year practice at PT Pros in Kentucky. Her management and clinical experiences include orthopedics, manual PT, industrial rehab, and women’s health, with expertise in chronic pain management. In addition, over the last 10 years, she has trained PTs to serve in Global Heath Outreach medical mission trips to Central and South America.
She is currently developing PT treatment programs in substance abuse and addiction recovery utilizing PT, pain neuroscience, and behavioral health services. She teaches a PT elective on how PTs can treat patients with chronic musculoskeletal pain (MSP), central sensitization, and substance use disorder (SUD). She is conducting ongoing research on early intervention PT in MSP and SUD with the University of Kentucky in AR.
She has served as an APTA KY Payment Policy Specialist since 2008 and on the APTA Private Practice Payment Policy Committee since 2013. She has been a frequent speaker at the APTA Private Practice annual conference and Combined Sections Meeting representing APTA Private Practice. She provides PT consulting services through Johnson PT Consulting LLC.

Paul Welk, PT, JD is an attorney at Tucker Arensberg, P.C. in Pittsburgh, Pennsylvania. He focuses his legal practice in the areas of business and health care law and in this capacity frequently represents physical therapists, rehabilitation providers, and professional organizations. Paul is a lobbyist and legal counsel for the American Physical Therapy Association of Pennsylvania. Paul is the founding author of The Legal Impact, a regular column in the APTA Private Practice Section's Impact Magazine.
