A physical therapy private practice can be established as any one of a number of separate and distinct legal entities or can be operated as a sole proprietorship. The type of legal entity or entities available to a physical therapist desiring to start a practice is largely dependent on state law. By way of example, a state may require a professional corporation, as opposed to a general business corporation, to be formed if a physical therapist desires to provide physical therapy services through a corporation. The type of legal entity ultimately selected is also largely driven by the practice's desired management structure and tax treatment, as set forth in detail in Chapter 3 of the How-To Manual.

Upon completion of this course, you will be able to:

-describe the most common business structure options for private practice physical therapy offices

-list the basic insurance coverage types to consider when opening a practice

-identify key legal, tax, and regulatory considerations to discuss with their advisors

Paul Welk, PT, JD is an attorney at Tucker Arensberg, P.C. in Pittsburgh, Pennsylvania. He focuses his legal practice in the areas of business and health care law and in this capacity frequently represents physical therapists, rehabilitation providers, and professional organizations. Paul is a lobbyist and legal counsel for the American Physical Therapy Association of Pennsylvania. Paul is the founding author of The Legal Impact, a regular column in the APTA Private Practice Section's Impact Magazine.
